
Jack Kelly Therapy Services Agreement
These terms and conditions govern the provision of therapeutic services by Jack Kelly Therapy Services (“us”, “we”, “our”). By either specifically agreeing to these terms and conditions or by accepting any of the services provided by us, you (“client”) confirm that you have read, understood, and accepted these terms, and agree to be bound by them.
1. Jack Kelly Therapy Services
a) Jack Kelly Therapy Services provides professional counselling and psychotherapy. Jack Kelly, owner and principal practitioner, is a qualified and registered counsellor and psychotherapist. Jack has a Bachelor of Counselling and is a Certified Practicing Member with the Psychotherapy and Counselling Federation of Australia (PACFA). As such, Jack Kelly Therapy Services adheres to the professional and ethical frameworks and Codes of Ethics established by PACFA, which serve as the foundation for this services agreement.
2. Service Expectations
a) Jack Kelly Therapy Services does not provide formal diagnoses, accept mental health care plans, or offer Medicare rebates.
3. Appointments
a) Jack Kelly Therapy Services offers both in-person and online appointments via ‘Google Meet’.
b) Bookings will be confirmed via email, at which point an agreement will be established between you and Jack Kelly Therapy Services, the terms of which are set out in this services agreement. By accepting any of the services provided by us, you confirm that you have read, understood, and accepted these terms, and agree to be bound by them.
c) To ensure a duty of care, online clients must be in a quiet, private, and safe space for their appointments. If clients are not in such an environment or are engaged in other activities, the appointment will be rescheduled to a more appropriate time. Clients are responsible for ensuring they have the necessary technology to attend and participate in online sessions.
d) The precise Brisbane location of in-person appointments will be notified to you upon confirmation of a booking.
4. Fees
a) As of October 2024 Jack Kelly Therapy Services charges $150 per appointment.
b) Fees are subject to change, with reasonable notice provided to clients.
c) Payment must be made after each appointment by way of electronic card reader or automatic direct debiting. If the mentioned forms of payment can not be completed an invoice will be issued and payment must be made within 48 hours.
5. Contact Between Appointments
a) If Jack Kelly Therapy Services needs to contact you we will do so by writing to your nominated email address provided upon booking.
b) Should you wish to contact Jack Kelly Therapy Services between appointments please email hello@jackkellytherapy.com.
c) Jack Kelly Therapy Services does not operate a crisis or emergency service. If you need to speak with someone immediately, please engage with the appropriate services at www.jackkellytherapy.com/extrasupport or in an emergency, call ‘000’.
6. Cancellations By Jack Kelly Therapy Services
a) Should there be any reason why Jack Kelly Therapy Services is unable to attend your appointment, you will be advised as soon as possible. In most instances, appointments will be rescheduled. If an appointment cannot be rescheduled, no fees will be charged.
7. Cancellations By The Client
a) We understand that circumstances may require you to cancel or reschedule your appointment. Due to limited availability, we request reasonable notice to accommodate such changes. This policy ensures fairness to both Jack Kelly Therapy Services and other clients who might have booked during your appointment time.
b) Rescheduling or cancellations must be made in writing via email (hello@jackkellytherapy.com).
c) No fee will be charged for any appointment cancellation communicated at least 24 hours in advance. If an appointment is cancelled with less than 24 hours notice before the commencement of that appointment, Jack Kelly Therapy Services reserves the right to charge a cancellation fee for the missed appointment.
8. Cancellation Fee
a) The cancellation fee is the full appointment amount. Jack Kelly Therapy Services will provide an invoice detailing the cancellation fee, which must be paid within 48 hours of issuance.
9. Late Arrivals
a) Late arrivals will only receive the remaining time of their scheduled appointment. If a client is more than 15 minutes late to an appointment, Jack Kelly Therapy Services may cancel the appointment and a cancellation fee may apply at the therapist’s discretion.
10. Questions & Complaints
a) You are welcome to contact Jack Kelly Therapy Services via email at hello@jackkellytherapy.com with any questions or complaints in regard to your treatment.
b) To lodge a formal complaint, you also have the right to contact Jack Kelly Therapy Service’s regulatory body, PACFA, at www.pacfa.org.au.
11. Privacy and Confidentiality
a) Jack Kelly Therapy Services maintains a confidential practice in accordance with PACFA Codes of Ethics. Contents of counselling appointments are kept confidential, including attendance of therapy.
b) Under the same Codes of Ethics, Jack Kelly Therapy Services will maintain written or electronic case notes of counselling appointments.
c) Jack Kelly Therapy Services uses computer software provided by Heidi Health, which is compliant with Australian Privacy Principles, to audio record and digitally transcribe notes of a counselling appointment. This assists your therapist to create accurate records. Your consent to this approach will be requested before your first appointment and you are entitled to decline to consent.
d) Any notes or records created by Jack Kelly Therapy Services are kept digitally in a secure manner as set by PACFA and Australian legislation standards. Release of those notes, records, or any other component of your information to any other party will require your written permission, except as otherwise provided for in this service agreement.
e) Counsellors and psychotherapists are required to have regular clinical supervision to ensure the best possible outcomes of their work. As such, de-identified cases may be presented to clinical supervisors to gain professional input and ensure best practices.
f) Jack Kelly Therapy Services may from time to time use video recordings of counselling appointments for clinical supervision purposes. This is to gain professional input and ensure best practices. You will be notified at the commencement of your appointment if Jack Kelly Therapy Services intends to make a video recording of the appointment. Your consent to this approach will be requested, and you are entitled to decline to consent.
12. Personal Information
a) Jack Kelly Therapy Services complies with the Privacy Act 1988 and the Health Records Act 2001 when handling personal information. As part of providing services, including counselling, assessment, treatment, and report writing, Jack Kelly Therapy Services will request and record personal information from you. In accordance with relevant privacy and confidentiality legislation, the information collected may include (but is not limited to) your name, contact details, medical history, employment status, and other relevant information deemed appropriate.
b) The collection of this information is necessary for your participation in therapy, and informed consent must be given before services commence. Your personal information is securely stored to document session content and to provide a tailored service based on your needs. If you do not consent to the collection of your personal information as outlined, we will be unable to proceed with providing therapeutic services.
13. Limits To Confidentiality
a) All personal information gathered by Jack Kelly Therapy Services during the provision of services remains confidential except when:
i. it is subpoenaed by a court or tribunal;
ii. failure to disclose the information would, in the reasonable belief of Jack Kelly Therapy Services place you or another person at serious risk to life, health or safety;
iii. it is deemed necessary to disclose de-identified information to a clinical supervisor in order to obtain guidance and provide best practice;
iv. you would reasonably expect your personal information to be disclosed to another professional or agency (e.g. your GP) and disclosure of your personal information to that third party is for a purpose which is directly related to the primary purpose for which your personal information was collected; or
v. disclosure is otherwise required or authorised by law.
b) In such cases, Jack Kelly Therapy Services will first discuss any decision to break confidentiality with you. However, Jack Kelly Therapy Services retains the right to break confidentiality without prior consultation with you if required by law, or should an assessment be made that the urgency of the situation requires Jack Kelly Therapy Services to act immediately to safeguard the physical safety of yourself or others.
14. Liability
a) Jack Kelly Therapy Services cannot foresee or guarantee the results or outcomes of any session or sessions, which are dependent on a variety of factors outside of Jack Kelly Therapy Services’ control.
b) By booking an appointment, you agree that Jack Kelly Therapy Services assumes no legal liability for any direct or indirect loss or damage arising from or in relation to any services provided by Jack Kelly Therapy Services under this services agreement.
c) To indemnify and hold harmless Jack Kelly Therapy Services from any claims arising from or in relation to any services provided by Jack Kelly Therapy Services under this services agreement.
